WetGo^®Free Car Wash Sweepstakes Official Rules

NO PURCHASE OR PAYMENT OF ANY KIND IS NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT INCREASE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED BY LAW.

1. PROMOTION PERIOD: Sweepstakes begins at 12:00:01 AM Eastern Time (“ET”) on September 9, 2020 and ends at 11:59:59 PM ET on November 3, 2020 (“Sweepstakes Period”).  

2. ELIGIBILITY: Sweepstakes is open only to individual legal residents of Ohio who are at least eighteen (18) years of age as of the Sweepstakes start date, and a Giant Eagle Advantage Card^® holder.  Employees, officers, and directors of Giant Eagle, Inc.(“Sponsor”) and their respective parent companies, subsidiaries, affiliates, advertising and promotion agencies, and the immediate families (spouses, parents, children, and siblings and their respective spouses) and those living in the same household (whether related or not) of such persons, are not eligible to participate.

3. HOW TO ENTER: There are two (2) ways to enter. (a) In-Store: Requires the purchase of one (1) $15.00 or $16.00 WetGo Showroom Car Wash by scanning your Giant Eagle Advantage Card at any one of the participating WetGo locations listed on Exhibit A and you will be automatically entered in the Sweepstakes.  If you are not already a Giant Eagle Advantage Card holder, during the Sweepstakes Period, sign up at any GetGo or Giant Eagle location, register by calling Customer Care at 1.800.553.2324, or request a Giant Eagle Advantage Card when you register an account with www.Gianteagle.com.  Registration and card usage are free; or (b) Mail-in entry without Purchase: To obtain an entry by mail, Entrants must hand print their first and last name, e-mail address, Giant Eagle Advantage Card number, and one (1) of the participating WetGo location on a 3”x5” card, place the card in an envelope with proper first-class postage affixed, and mail the envelope to Columbus WetGo Unlimited Sweepstakes, c/o GetGo Marketing Team 45 Mclntyre Square Drive, Pittsburgh, PA 15237.  Incomplete entries will be disqualified.

Limit: Two (2) entries per person regardless of entry method or participating location during the Sweepstakes Period.

4. TERMS OF SUBMISSION. Any attempt by any Entrant to obtain more than the permitted number of entries by using multiple and/or different identities, forms, registrations, addresses, or any other method will void all of that Entrant’s entries and that Entrant may be disqualified at Sponsor’s discretion.  Multiple Entrants are not permitted to share the same Giant Eagle Advantage Card.  Normal Internet, phone, and usage charges imposed by your online or phone service may apply.  Sponsor is not responsible for lost, late, incomplete, damaged, stolen, misdirected, or illegible entries; lost, interrupted, or unavailable network, server, or other connections; or miscommunications, computer or software malfunctions, telephone transmission problems, technical failures, garbled transmissions, damage to a users computer equipment (software or hardware), or other errors or malfunctions of any kind whether, human, mechanical, electronic or otherwise. Proof of sending or submission will not be deemed to be proof of receipt by Sponsor. In the event of a dispute as to the identity of an Entrant, the authorized account holder of the Giant Eagle Advantage Card used to enter will be deemed to be the Entrant or participant.  The "authorized account holder" is the natural person assigned a Giant Eagle Advantage Card number by the Sponsor.  Potential winner may be required to show proof of being the authorized account holder.  Entries specifying an invalid, non-working, or inactive email address will be disqualified and ineligible to win.

5. SELECTION OF WINNERS:   On or about November 4, 2020 an authorized representative of Sponsor will randomly select one (1) Entrant from each participating WetGo location from among the eligible entries received during the Sweepstakes Entry Period (each a Potential winners”). Seven (7) total Potential winners. Potential winners agree to be bound by these Official Rules, which are final and binding in all respects.  Potential winners will be notified by email within approximately 48 hours after the Drawing.  Unless otherwise prohibited, potential Prize winners may be required to sign and return an Affidavit of Eligibility and Liability/Publicity Release (where legal) within ten (10) days of notification attempt or Prize will be forfeited.  If a potential winner cannot be contacted or the notification is returned as undeliverable within three (3) days after the attempt, or if he/she fails to sign and return the Affidavit of Eligibility and Liability & Publicity Release  the Prize may be forfeited, and an alternate winner may be selected time permitting.  In the event that a potential winner of a prize is disqualified for any reason, prize may be awarded to an alternate winner, at Sponsor’s sole discretion.

6. PRIZES/ODDS: Seven (7) prizes (one (1) winner per participating WetGo Location): Each winner will receive a one (1) year WetGo Unlimited Showroom Wash package subscription ($29.99 per month). The approximate retail value (“ARV”) of the Prize is: $359.88.  The ARV of all Prizes is: $2,519.16.

Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and use of prize not specifically stated herein are the responsibility solely of the prize winners.  Prizes are non-transferable and no cash equivalent or substitution of any prize is offered, except at the sole discretion of the Sponsor.  Sponsor may substitute a prize of comparable value if the Prize becomes unavailable.  Purchases of alcohol, tobacco, milk, and prescription drugs are excluded when Giant Eagle/GetGo/Wetgo gift cards are provided as prizes.

The odds of winning will depend upon the number of eligible entries received per participating location.

7. ENTRY CONDITIONS AND RELEASE: By entering, each Entrant agrees to: (a) comply with and be bound by these Official Rules and the decisions of the Sponsor, which are binding and final in all matters relating to this Sweepstakes; (b) release and hold harmless the Sponsor and their respective parent, subsidiary, and affiliated companies, the prize suppliers and any other organizations responsible for sponsoring, fulfilling, administering, advertising or promoting the Sweepstakes, and all of their respective past and present officers, directors, employees, agents and representatives (collectively, the "Released Parties") from and against any and all claims, expenses, and liability, including but not limited to negligence and damages of any kind to persons and property, including but not limited to invasion of privacy (under appropriation, intrusion, public disclosure of private facts, false light in the public eye or other legal theory), defamation, slander, libel, violation of right of publicity, infringement of trademark, copyright or other intellectual property rights, property damage, or death or personal injury arising out of or relating to an Entrants entry, creation of an entry or submission of an entry, participation in the Sweepstakes, acceptance or use or misuse of prize (including any travel or activity related thereto) and/or the broadcast, exploitation or use of entry; and (b) indemnify, defend and hold harmless the Released Parties from and against any and all claims, expenses, and liabilities (including reasonable attorneys’ fees) arising out of or relating to an Entrant’s participation in the Sweepstakes and/or Entrant’s acceptance, use or misuse of prize.

8. PUBLICITY: Except where prohibited, participation in the Sweepstakes constitutes each Sweepstakes Winner’s consent to Sponsors and its agents’ use of Sweepstakes Winner’s name, likeness, photograph, voice, opinions, and/or hometown and state for promotional purposes in any media, worldwide, without further payment or consideration.

9. GENERAL CONDITIONS: Sponsor reserves the right to cancel, suspend and/or modify the Sweepstakes, or any part of it, if any fraud, technical failures or any other factor beyond Sponsor’s reasonable control impairs the integrity or proper functioning of the Sweepstakes, as determined by Sponsor in its sole discretion. Sponsor reserves the right in its sole discretion to disqualify any individual it finds to be tampering with the entry process or the operation of the Sweepstakes or to be acting in violation of these Official Rules or any other promotion or in an unsportsmanlike or disruptive manner. Any attempt by any person to deliberately undermine the legitimate operation of the Sweepstakes may be a violation of criminal and civil law, and, should such an attempt be made, Sponsor reserves the right to seek damages from any such person to the fullest extent permitted by law. Sponsor’s failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

10. LIMITATIONS OF LIABILITY: The Released Parties are not responsible for: (1) any incorrect or inaccurate information, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in the Sweepstakes; (2) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (3) unauthorized human intervention in any part of the entry process or the Sweepstakes; (4) technical or human error which may occur in the administration of the Sweepstakes or the processing of entries; or (5) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in the Sweepstakes or receipt or use or misuse of any prize. If for any reason an Entrant’s entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant’s sole remedy is another entry in the Sweepstakes. No more than the stated number of prizes will be awarded.

11. DISPUTES: Entrant agrees that: (i) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, other than those concerning the administration of the Sweepstakes or the determination of the Sweepstakes Winners, shall be resolved individually, without resort to any form of class action; (ii) any and all disputes, claims and causes of action arising out of or connected with this Sweepstakes, or any prizes awarded, shall be resolved exclusively by the United States District Court or the appropriate Pennsylvania State Court located in Allegheny County, Pennsylvania; (iii) any and all claims, judgments and awards shall be limited to actual out-of-pocket costs incurred, including costs associated with entering this Sweepstakes, but in no event attorneys’ fees; and (iv) under no circumstances will Entrant be permitted to obtain awards for, and Entrant hereby waives all rights to claim punitive, incidental and consequential damages and any other damages, other than for actual out-of-pocket expenses, and any and all rights to have damages multiplied or otherwise increased. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, or the rights and obligations of the Entrant and Sponsor in connection with the Sweepstakes, shall be governed by, and construed in accordance with, the laws of the Commonwealth of Pennsylvania, without giving effect to any choice of law or conflict of law rules (whether of the Commonwealth of Pennsylvania or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the Commonwealth of Pennsylvania.

12. ENTRANT’S PERSONAL INFORMATION: In conjunction with participation in the Sweepstakes, you are providing your information to Sponsor.  Information collected from Entrants is subject to the Sponsor’s Privacy Policy.

13. SWEEPSTAKES RESULTS: To receive the names of the prize winners by mail please mail a self addressed stamped envelope, postmarked within 90 days of the Sweepstakes end date, to Columbus WetGo Unlimited Sweepstakes Winners List, c/o Marketing, 45 McIntyre Square Drive, Pittsburgh, Pennsylvania 15237.
